Part 1. Suspicious Collusion between Henrico County Officials in Dismissing Charges against Child Molester.

 Shannon Taylor and Judge Lee Harris Corruption Exposed in Famous Actor Child Molester Case

   Highly suspicious and irregular activity involving a famous Hollywood actor, charged with four counts of sexual molestation of a minor, has been exposed in Henrico County Commonwealth Attorney Shannon Taylor's voluntary dismissal of the felony charges with prejudice despite hard evidence and numerous witnesses in the case.

   Henrico Police records show that David Randolph Gibbs had failed the polygraph test given to him and that HPD Detectives stated that they did not doubt that the victim was telling the truth. Child Protective Services (CPS) have classified sexual assaults as Founded Level One, the highest level. Although CPS supported the victim’s claims which were disclosed to CPS during intensive therapy in a group home evaluation, CPS filed complaints with the HPD sometime in June 2021. CPS reports stated that Gibbs threatened to kill the minor if he ever told anyone; despite the threats, Gibbs was not charged by the HPD.

   David Randolph, Gibbs of 11232 Fanwood Court, Richmond, Va., was indicted by a grand jury on May 16, 2022, on two counts of forcible sodomy on a child less than 13 years old, violating Va. Code §18.2-67.1 and two counts of carnal knowledge of a child 13-14 years old violating Va. Code §18.2-63. The offenses occurred between February 2018 through December 2020. The grand jury indictments list the victim as a close family member of David R. Gibbs and that he was the victim’s uncle.

   The case numbers listed with the Henrico County Circuit Court are CR22001419, CR22001420, CR22001421, and CR22001422. A capias for Gibbs' arrest was issued on May 16, 2022; Gibbs evaded arrest from Henrico police detectives, and another capias was issued on May 20, 2022, and was ordered that Gibbs be arrested and held without bond. Gibbs was arrested 27 days later, on June 13, 2022, and appeared before the Henrico Circuit Court on June 14, 2022.

      David R. Gibbs was released on a $20,000. bond on June 14, 2022, conditions of his bail were that he not have any contact with minors other than his biological children, wear a GPS monitor, and sign a non-extradition waiver as Gibbs travels to and from Los Angeles for his acting career. Henrico Circuit Court records list David R. Gibbs’s residence at 11232 Fanwood Court, Henrico County, 23222, and he is married with two children. 

   The trial was scheduled for two days on January 10-11, 2023, but an unpredicted early motion on December 22, 2022, by the Commonwealth Attorney Shannon Taylor, who suspiciously moved for Judge Lee A. Harris to dismiss the four counts without hearing any evidence in the case or the testimony of witnesses.
    On December 15, 2022, Judge Lee Harris rejected the Commonwealth's Motion for Nolle Prosequi and demanded the charges be dismissed with prejudice, which Judge Lee Harris granted the Defendants Motion to Dismiss with Prejudice on December 22, 2022 and released David Gibbs.


   Assistant Henrico Commonwealth Attorney Bernard McGhee, who was assigned to the case by CA Shannon Taylor, wanted the Nolle Prosequi Motion granted, as the Commonwealth could file the charges against David Gibbs at a later date.

   Assistant Henrico Commonwealth Attorney Bernard McGhee was surprised by the motion to dismiss by Taylor. McGhee disagreed with the motion to dismiss with prejudice, but CA Shannon Taylor has the authority to decide the Commonwealth's position on cases.

  CPS reports stated that the molested minor was still undergoing therapy and might not be able to testify at that time because of the severe trauma inflicted on him by David Gibbs over a period of 2-3 years.

  Confidential sources at the Henrico Commonwealth Attorney's office have stated that the dismissal of charges considering the amount of hard evidence and expert witness testimony against Gibbs, was highly irregular and suspicious with no explanation by Shannon Taylor. 

   An HPD official who wished to remain anonymous stated that CA Shannon Taylor instructed the HPD to keep the case details confidential and not to release the names of David Randolph Gibbs and his parents, John W. Gibbs Jr. and Martha C. Gibbs, to the news media. As a result, the capias and arrest reports were not recorded in the logs that the news media have access to.  

    Henrico police reports indicate that the child molestation occurred at the grandparent’s home while the grandchildren were visiting from North Carolina, where they reside with their parents. The minor boy is listed as the nephew of David R. Gibbs and grandson of John W. Gibbs Jr. and Martha C. Gibbs, who reside at 204 Dryden Lane, Henrico County, an upscale community in the Sleepy Hollow/Mooreland Farms area.
